We are frequently asked about the information we collect and how we use it. Please read the following FAQ's:
1. What is personal information?
Personal information is any information about an identifiable individual. This does not include information which is publicly available such as a phone directory listing, your name, address and telephone number.
2. How do REALTORS collect personal information?
Most information will be obtained directly from you, the client. REALTORS may also collect information from other sources such as credit bureaus and government agencies, as needed. At the time information is collected, you will be told what uses will be made of it, and your consent to that collection and use will be obtained.
3. What do REALTORS do with my information?
Your information is used to facilitate the real estate transaction. Effectively marketing your house involves advertising the property in any medium, including electronic media (newspapers, real estate publications, Internet web sites) and will also disclosing property information to other salespersons and prospective buyers. If the listing is on MLS®, the property information will be given to the real estate board or boards operating the Multiple Listing Service(s)®. The listing information will be distributed through the MLS® system to any persons authorized to use the service (which may include other REALTORS, appraisers, government departments and others) and may be marketed by the board in various media, including the Internet. Property information, including sales data, is kept in the MLS® database following the completion of the transaction and is available to users of the system for comparative market analysis and valuation purposes. Both current and historical data is essential to the operation of the MLS® system and by placing your listing on the MLS® system, you are agreeing to allow this ongoing use of listing and sales information.

CREA Privacy Code: The 10 Principles of PIPEDA:

The Privacy Code of The Canadian Real Estate Association sets out the commitment of REALTORS regarding the privacy of your personal information:
PRINCIPLE 1 - ACCOUNTABILITY
Members are responsible for the proper management of all personal information under their control, and shall designate one or more persons to be accountable for compliance.
PRINCIPLE 2 - IDENTIFYING THE PURPOSES OF PERSONAL INFORMATION
Members shall identify the purposes of collecting information before or at the time the information is collected.
PRINCIPLE 3 - OBTAINING CONSENT
The knowledge and consent of the consumer are required for the collection, use or disclosure of personal information except where inappropriate.
PRINCIPLE 4 - LIMITING COLLECTION OF PERSONAL INFORMATION
Members shall limit the collection of personal information to that which is necessary for the purposes identified.
PRINCIPLE 5 - LIMITING USE, DISCLOSURE AND RETENTION OF PERSONAL INFORMATION
Members shall use or disclose personal information only for the reason it was collected, except with the consent of the consumer or as required by law.
PRINCIPLE 6 - ACCURACY OF PERSONAL INFORMATION
Members shall keep personal information as accurate, complete, current and relevant as necessary for its identified purpose.
PRINCIPLE 7 - PROTECTING INFORMATION
Members shall protect personal information with safeguards appropriate to the sensitivity of the information.
PRINCIPLE 8 - OPENNESS CONCERNING POLICIES AND PRACTICES
Members shall make readily available to consumers specific information about their policies and practices relating to the management of personal information.
PRINCIPLE 9 - CONSUMER ACCESS TO PERSONAL INFORMATION
Upon request, members shall inform a consumer of the existence, use and disclosure of his or her personal information and shall give the individual access to that information.
PRINCIPLE 10 - CHALLENGING COMPLIANCE
A consumer shall be able to address a challenge concerning compliance with the above principles to the designated accountable person or persons in the member office.

CREA Privacy Code - Privacy and REALTORS

In the usual course of real estate transactions, REALTORS may require from buyers and sellers, personal and property information. Some of this information may be considered private. Collecting and sharing this and the real estate transaction information is an essential part of the buying and selling process.

At the same time, few things are more important to individuals than their privacy. REALTORS recognize the rights of buyers and sellers to protect and control their personal information. REALTORS are committed to using fair information practices when dealing with your personal information.

The CREA Privacy Code is based on the 10 principles of PIPEDA, the privacy legislation. Our Code has been in place since 2001, and is the declaration of organized real estate to the public that we respect the privacy rights of individuals and have adopted policies and procedures to protect those rights.

Forms on this site and information given to you

You must first read through and understand and accept the terms of Agency and this Agreement.  By accepting the terms of this agency agreement and relationship, it allows the me and my representatives and the Broker to share information with you regarding listings and other matters based on our Agency Relationship.

When you fill out information on one of my forms requesting MLS data of any type, you are agreeing that you are not under buyer agency contract with another broker and agree and have read the terms of agency agreement and you agree to the privacy terms above and you also are explicitly stating that you agree to become a client under RE/MAX Realty Specialists Inc. and Mark Argentino, Broker, as their authorized agent and extension of the company.

You also agree that when you fill out an online form at my site, you'll have on-line access to valuable, up-to-date information regarding all MLS properties that include address, city assessment, days on the market and so much more.  When you complete any form located at this website you agree to hire MARK ARGENTINO of Re/Max Realty Specialists Inc., Brokerage to act as your Buyers Agent for a period of 60 days.  You also agree that if you resubmit any forms in the future or request further information from this website or directly from Mark Argentino or one of his team associates that this act shall extend this agreement for an additional 60 days from the time you resubmit a form or ask for more information.

Online property evaluations and over the internet evaluations

Please understand that I can only do evaluations for properties that are located within my trading area.  I cannot give you an evaluation for your property if it's located outside of my trading area, that would be unprofessional and against our code of ethics and RECO guidelines to provide accurate and conscientious service.  If you choose to fill out my online evaluation form and I cannot do the evaluation you agree that I can have my associate, partner do the evaluation or refer you to an agent in your trading area who can do the evaluation.  Normally, I will ask you for your permission before referring you to an agent in your area, but this is not a requirement.  As well, and as always with all forms on my site, you agree to also sign up to my monthly real estate newsletter at the same time you fill out the evaluation form.

Power of Sales and Foreclosure section of my site

You fully understand that the Power of Sale (POS) listings that I send you are for the most part other broker listings. I've personally listed many power of sale properties during my real estate career, but the power of sale properties contained in the newsletter or links in the newsletters that I send you are almost all power of sale properties that are listed by other brokers. My email newsletter to you contains links to these listings that I have personally searched on TREB MLS system and organized into an email format that is easy for you to read. Any other agent or broker who is a member of TREB can supply this information to you. You are at liberty to call me or the listing broker or any other brokerage or agent who you feel is competent to give you more information about these POS properties and/or to show you these properties. These POS properties contained in the email and/or newsletter that I send to you are NOT my exclusive listings nor do I have exclusive rights to these listings. The point of the MLS is to allow sharing of these POS listings, all listings in fact, for the benefit of members and the public and any registered agent may show you these properties.

By submitting your name, email and other information to us via one of our forms you are asking us to provide you with information.  You hereby release Mark Argentino from the obligation of providing this information and relying upon this information when you make any buying or selling decision regarding real estate.  You also agree that this information is given to you because you specifically have asked me to provide you with power of sale properties within the GTA and that you also agree to keep this information to yourself and not disclose to anyone anywhere that these listings are power of sale listings and that you will not forward these listings to any other person at any time.  You also agree that by signing up to my power of sale newsletters and receiving the power of sale listings that you shall not disclose any information to any third party and that you give your undertaking that you are not working with another real estate agent under buyer agency.  If you are under buyer contract you give your undertaking that you will immediately unsubscribe from my newsletters and agree to not use any of the information received by me in any way shape or form.  The reasons for these statements are because there are situations where the information that I gather and/or receive is not reliable or is out of my hands and I cannot be held responsible for things out of my control.  For example, some sellers that are selling their property by exercising their rights under the power of sale privilege contained in the mortgage don't want the public and/or real estate agents to know that they are selling under power of sale and/or they don't want to make it obvious in the MLS listing that they are selling under power of sale or they don't want their listings advertised as power of sale properties.  You have specifically employed me and asked me to provide you power of sale properties and this is what is contained within the power of sale newsletters that I send you. 

Again, you must first read through and understand and accept the terms of Agency and this Agreement.  By accepting the terms of this agency agreement and relationship, it allows the me and my representatives and the Broker to share information with you regarding MLS listings and other matters based on our Agency Relationship.  If you do not agree with the agency relationships and this agreement or any of the conditions contained within this power of sale section or any other section on this page or any other page of my website, then you shall unsubscribe from my newsletters or send me an email asking me to remove you from the email list.

When you fill out information on one of my forms requesting MLS data of any type, you are agreeing that you are not under buyer agency contract with another broker and agree and have read the terms of agency agreement and you agree to the privacy terms above and you also are explicitly stating that you agree to become a client under RE/MAX Realty Specialists Inc. and Mark Argentino, Broker, as their authorized agent and extension of the company.

There are many reasons why a seller who is selling their property under the power of sale provision contained within the mortgage would want to keep this fact away from the public.  One reason for this may be that they feel the property will sell for less than market value if the public knows this fact.  In their MLS listing they may not state that their property is being sold under power of sale using the language and/or in the location that I perform my research for you and our system would not pick up on the fact that this property is being sold under power of sale.  In this example, you would not receive a copy of this listing from me in my regular POS newsletters and as stated herein, you cannot and shall not hold me responsible for this omission whether it's due to my research system, my error, my omission, my mistake or otherwise and certainly for something that is completely out of my control.  As well, I may make an oversight when searching or a mistake when entering search criteria, again, you cannot hold me responsible for any of these errors or omissions.  This service is a free service that I offer to you and I have the right to send you and filter the information as I see fit or not send you listings at my sole and absolute discretion and I may stop sending you this information at any time at my complete absolute discretion.  Again, if you are a real estate agent reading this and you are currently subscribed to receive my POS listings, you must read this section of my site.

Another situation may arise where my computer equipment or website is not functioning properly or I am out of town or on vacation or just not sending you POS newsletters during a particular time period or not able to search properties or power of sale properties for you on one particular day or time period and although new POS properties come on the market during this time period, I was not able to send you an update or copy of the listing due to the reasons above or for any other reason at my absolute discretion.  Under these circumstances or any other circumstances, whether they are created on purpose or not, that cause me to not send you the power of sale or neighbourhood watch emails showing regular, new or changed MLS listings you also release me from any obligation and hold me harmless in the event you incur any loss or any damage due to any delay this may have caused you.

Use of IP address
