These are the limiting conditions to my guarantees, otherwise known as "the fine print"

This limiting conditions are in place to protect you and me in the event of a dispute or unforeseen problem. The guarantees that I give you are given in good faith and with good faith on both sides in mind

There are 5 Written Guarantees when you Sell your home with Mark

  1. "EASY EXIT LISTING" ~ If any time (before the offer!) you are not 100% satisfied with Marks services, you can cancel your listing, without obligation.
    The limiting condition with this guarantee is that you cannot invoke this guarantee when we have an offer registered or contemplated from a purchaser.  You cannot use this guarantee just to avoid paying commission, the true intent of the guarantee is that if you do not feel that I am living up to my promises or obligations or we have a falling out for some reason, then I want you to know that I will release you from your obligations of the listing contract with no strings attached and you may list the property with any other agent or keep it off the market, it's up to you.  I will not release you so you can avoid paying commission, directly or contemplated. 
  2. "YOUR CALL RETURNED IN 1 HR." ~ If Mark doesn't return your call within one hour, he will reduce his commission by $100 for each occurrence.  
    The limiting condition with this guarantee is that it only applies if my answering service or office paging system is functioning and that my phone is in a position to receive pages.  For example, when I was in Jamaica in December of 2004 my pages would be received about 6 to 10 hours after they were paged out, this guarantee would not apply in this case.  As well, I have had occasion where I was up in northern Ontario (the worst areas seem to be Parry Sound and Haliburton areas) and pages were not getting to me due to no signal or cell sites within paging distance or reach.  In any case where I do not have a signal and it is impossible for me to receive a page or phone call and it is out of my control, then I cannot honour this guarantee. I think this is fair and makes sense.  Again, this is a good faith guarantee and I will honour it for any reason that I do not return your calls within an hour.   I offer this guarantee because I return all my calls usually within one minute to 15 minutes of receiving the page from my office!
  3. "MARK WON'T FORGET YOU!" ~ Mark will call you at least once per week during the currency of the agreement or for every week missed he will take off $200.
    The limiting condition with this guarantee is that you cannot invoke this guarantee if I am on vacation, otherwise, you will hear from me or receive an email from me at least once per week!
  4. "COMMITMENT IN WRITING!" ~ A 16-point Marketing System ~In Writing~ for you to follow to ensure you're getting what you signed for, or you can fire him!
    No limits on this guarantee, you will receive what I say you will receive.
  5. "Personal Comparable Market Analysis" ~ Mark will provide you with a detailed computerized market analysis, (not just printouts of listings), to help you in pricing your home to sell.
    The limiting condition with this guarantee is that occasionally I will only have the time to bring you mls listings to the listing appointment, when this is the case and you specifically ask for a personal CMA I will do it for you, but it will have to be done after the appointment.
  6. "If I list and sell I will reduce the commisision"
    The limiting condition with this guarantee is that if we are in multiple offer situation, then I cannot reduce the commission, otherwise, this guarantee holds true.

2 Written Guarantees when you buy your next home with Mark

  1. "SATISFACTION GUARANTEED" ~ If you buy your next home through Mark and are unhappy with it for any reason, Mark will sell it within the next one month FREE!
    The limiting condition with this guarantee is that you cannot invoke this guarantee to make a profit or to avoid commission.  For example, if your sale price is greater than 2.5% (the amount paid to the selling agent of your property) plus $1850 over what you paid for the property (regardless of any other costs or expenses that you incur) then you must pay me commission on the balance.  HST or other costs does not enter this equation and are extra.  As well, you have to pay the minimum $1850 plus HST (GST+PST) to cover my minimum RE/MAX transaction fee.  Also, if your situation changes and you have to move elsewhere (for example: due to job transfer), this guarantee does not apply.  If you get transferred or your marital situation or personal situation changes, the guarantee does not apply.  The intent is to help you if you truly made a mistake buying the property for some reason.
    You must be sure that the HST does not apply, please read about New rules with the HST, please check the Ontario government HST websites
  2. "KNOW WHAT YOU'RE BUYING, FIRST" ~ Mark will provide you with computer printouts of homes in your price range, which meet your needs, then you choose the homes to see. He'll show you the typical buyer costs before you buy.
    No limits on this guarantee, this is what I will do for you when you buy a home.
