Limiting Conditions and the fine print

Below are details and some of the limiting conditions for the guaranteed sale plan as it may have been explained to you, my guaranteed sale program generally works like this. 

• You get an independent appraisal done on the property and so do I. 
• As long as they are within 5% of each other, then we negotiate a firm agreement of purchase and sale on your property with me as the purchaser. 
• You purchase one of my listings with a firm offer.
• We try and sell your property during the guarantee period, which is usually 60 to 90 days.
• You have to follow our marketing plan and marketing advice regarding the asking price and marketing of the property.  We need full control of your property to market it correctly.
• If your property does not sell during this time, you can accept our firm agreement of purchase and sale and you are sold at the previously agreed to price and terms. 
• You have to pay the full commission rate, plus all of our purchase costs including, but not limited to the land transfer tax, legal fees and disbursements on the purchase and sale, house carrying costs up to the closing date plus a 3% administration fee which includes the set up of the guaranteed sale, the appraisal, marketing costs and any other out of pocket expenses that we incur on the guaranteed purchase and sale.
• The point of the guaranteed sale is so you have the peace of mind and money to go ahead with your firm purchase of one of my listings.

Sound simple? It is.

In addition to the information above, our company has a guarantee sale program policy that I must follow. One of the requirements of the guarantee sale is that everything that I offer to you with this guaranteed sale follows the rules of the Real Estate and Business Brokers Act (REBBA) with regards to advertising the guarantee.  As well, my guarantee must follow the Registrar of REBBA guidelines.

First and foremost, the guarantee is not an inducement for you to purchase a property, although that is one of the requirements of the plan.  I also wish to point out that although my company will provide me with guidelines and help with this guaranteed sale, I am offering this guarantee as an independent contractor and this plan is offered by me and is not financially guaranteed or financially backed by RE/MAX.  With that said, I have the means and financial capability to offer this guarantee sale for your home up to only a certain price point.  For example, one limitation is that I will not guarantee the sale of any home over CDN$600,000

In addition, my offer of a guarantee sale as stated herein and on my website is that you must purchase one of my current listings, not just any property on the mls.
