Every real estate agent must abide by the following four professional Duties and Standards.

Duties I owe to YOU, the Public

For ALL Real Estate Agents

The Codes below relate to my Duties to you, Clients and Customers, under the Law

These are the Duties I owe to YOU, the Public

ARTICLE 17

A REALTOR is obliged to render a skilled and conscientious service, in conformity with standards of competence which are reasonably expected in the specific real estate disciplines in which the REALTOR engages. When a REALTOR is unable to render such service, either alone or with the aid of other REALTORS, the REALTOR should not accept the assignment or otherwise provide assistance in connection with the transaction.

Interpretations:

1. A REALTOR should not provide services relating to the sale, purchase, appraisal, management, financing or other involvement pertaining to a real estate transaction where the REALTOR's level of expertise is not on a level that could be reasonably required under the circumstances. Where services are required in such areas and the REALTOR does not have the appropriate level of expertise, such services should not be provide without the aid of another REALTOR who is properly qualified in the area of activity being contemplated. (Also applies to Article 14)

ARTICLE 18

REALTORS shall ensure a true presentation in all advertising. Properties and services shall not be advertised without identifying the firm, the individual practitioner, in accordance with provincial licensing legislation.

Interpretations:

1. The contents of a REALTOR's advertising, in any form should accurately reflect the property or services being advertised. (Also applies to Article 25)

2. A REALTOR should not advertise property in any form or in any medium in any manner that is contrary to the requirements of provincial legislation. (Also applies to Article 25)

3. No REALTOR should advertise any property owned by himself or herself or by another person without identifying the REALTOR as a real estate practitioner, and such identification should be in the manner that may be required by the applicable regulatory legislation.

4. This article does not apply to truthful advertising by REALTORS. Any advertising by a REALTOR which contains seemingly derogatory statements about competitors, their businesses or their business practices may form the basis of an ethics charge only if such statements are false or misleading within the meaning of the Competition Act, are otherwise prohibited by law, or relate to information that was restricted from use at the request of the vendor. (Also applies to Article 22)

ARTICLE 19

The REALTOR shall not deny professional services to any person for any reasons of race, creed, colour, sex, marital status, age or country of national origin. The REALTOR shall not be party to any plan or agreement to discriminate against a person or persons on the basis of race, creed, colour, sex, marital status, age or country of national origin.

ARTICLE 20

The REALTOR shall observe the By-Laws, Rules and Regulations established by the REALTOR's Real Estate Board and/or Association, in addition to the regulations, terms and conditions associated with any designation that the REALTOR may hold through membership in the Canadian Real Estate Association.

ARTICLE 21

The business of a REALTOR shall be conducted in strict accordance with all statutory and regulatory requirements that apply to that business.

Interpretations:

1. The REALTOR should not be party to any discussion or agreement where the intent of such discussion or agreement is to circumvent any statutes or regulations affecting the real estate industry.
